Service tax: Norms for point of taxation simplified

The Finance Ministry has come to the rescue of industry and professionals by considerably simplifying its norms on ‘point of taxation' for service tax collection purposes. The point of taxation will now be primarily linked to date of invoice/collection, according to the latest changes made by the Central Board of Excise and Customs (CBEC). The simplification has come a month after the original norms were issued and would help allay the concerns expressed by industry. Point of taxation refers to the time when a taxable service should be brought to service tax. Prior to the latest changes, the point of taxation was also linked to the date of provision of services/date when services were to be provided. This has now been dropped. The point of taxation was hitherto decided as the earlier date of invoice, date of collection or date of provision of services/date when services were to be provided. Meanwhile, it has now been clearly spelt out that the point of taxation for services exports will be the date of payment. Also, professionals such as chartered accountants, company secretaries, architects and interior decorators need to pay service tax only when they receive payment for their services and not on accrual basis. This will come as a big relief for small practitioners and professionals as they generally get payments for their services after a gap of 4-6 months.

Section 80-D of Income Tax for Medical Insurance

Friends,

Today, we will discuss about deduction under section 80-D which covers Medical Insurance. Nowadays life is very hectic. Everyone is in the race to earn more money. In this way proper care for health is being ignored. So there is one way to be aware about your Health i.e. medical insurance. Mediclaim insurance is a must-have for all. It safeguards you and your family from a financial crisis during critical illnesses or accidents. Apart from covering medical expenses, health insurance also offers you access to tax saving schemes. Absence of Medical insurance can wipe out your savings.

Deduction U/s. 80D of the Income Tax Act, 1961 in respect of Medical Insurance Premium (Mediclaim) paid, to keep in force insurance by individual either on his own health or on the health of spouse, dependent parents and children or paid by HUF on the health of any members of the family.

Features of Mediclaim policy

1. Premium based on Age: - As in term insurance, the premium rates will vary among the insurers and will also depend on your age. The older you are, the heftier the premium. For instance, Mediclaim policy from General Insurance Corporation has a fixed premium till 35 years and then it changes in 10-year slabs.

2.    Who is it available to?

    *Individual (resident or non resident, Indian Citizen or foreign citizen):- In case an individual is taking the deduction, the medical insurance policy can be taken in the name of any of the following or jointly in the name of following:

* the taxpayer

* spouse of the taxpayer

* parents :- Parents need not be dependent on the Assessee and parents of spouse are also covered.

* Dependent children (i.e. legitimate or legally adopted children) of the taxpayer: - Children above 18 years, if employed, can not be covered. Male children, if not employed, but a bonafide student can be covered upto age of 25 years. Female children, if not employed, can be covered until the time she is married.


      HUF(Hindu undivided Family may be resident or non resident) :- In case a HUF is taking the deduction, the medical insurance policy can be taken in the name of any member of the family.
  
     

3. Entry Age: This insurance is available to a person between the age of 18 to 59 years.  However, the Policy can be renewed upto the age of 80 years.


a) Children above the age of 3 months can be covered provided parents are covered concurrently and suitable premium is paid. If the child above 18 years is employed or if the girl child is married, he or she shall cease to be covered under the policy. However male child can be covered upto the age of 25 years if he is a bonafide regular student and fully dependent on primary insured. Female child can be covered upto the time, she is unmarried.

b) If the insured has taken continuous Mediclaim insurance policy with us for at least 5 years prior to attaining the  age of 80 years the policy can be renewed beyond the age of 80 upto  the age of 90 years as a special case with the approval of Regional Incharge on case to case basis. The premium chargeable shall be 10% of the premium for 75-80 years age slabs for  proposers above 85 and 20% of the premium for 75-80 age slabs for proposers above 90.

c) No inclusion of family member during currency of policy is permissible except for a new born child between the ages of 3 months to 6 months and newly married spouse within 60 days of marriage.  Otherwise inclusion of family member shall be allowed only at the time of renewal. Prorata premium shall be charged for such inclusion during the currency of the policy for the unexpired period.



4. Sum Insured: Minimum sum insured shall be Rs 50,000/- and can be increased in multiples of Rs 25,000/-upto Rs 5 lacs.  The sum insured must be identical for primary insured and the dependents. However, the children may be covered for 50% Sum Insured as per 4 above.

5.     In addition to deduction u/s, 80C, 80CC and 80CCD,:- This is an additional deduction available which do not include deduction  u/s 80C, 80CCC and 80CCD for which overall limit is Rs. 1,00,000.

6. Partly contribution: If part payment is done by you and part payment by the parent, both can claim deduction to the extent of their contribution subject to maximum allowed but amount should be paid directly to insurance company and paid through mode other than by cash.

7. Payment of Mediclaim Premium out of taxable Income:- The amount must have been paid using the taxpayer’s income chargeable to tax.

8. Mode of payment: The premium may be paid by any mode of payment other than cash. Please note, prior to 1st April 2009, premium payment was required to be done only by cheque. Credit card or other online payment mechanism where not allowed. Now all payment modes except cash payment are accepted.

9. Which Mediclaim Premium is allowed? : - Mediclaim premium paid under Medical insurance scheme of General Insurance Corporation approved by the Central Government, or any other insurer approved by the Insurance Regulatory & Development Authority (IRDA).

10. Things You Must Know Before Buying Health Insurance

* Buy a basic health insurance plan, which  is an indemnity policy that reimburses all the medical costs incurred during hospitalization.

* Buying a health insurance policy for you family from the same insurer could entitle you to a discount of up to 10 per cent of your premium.

* A basic policy pushing up the sum insured by 5 per cent every year that you do not make a claim. If a claim is raised on your policy, the accrued bonus is reduced by 10 per cent till sum insured is reached.

* You could push up basic policy by adding defined benefit plans.

* The plans offered by life insurer come with death cover.

* If you are relying on the medical benefits given by your employer, then during the period between two job, your policy might suffer a break. Buy having medical Insurance plan on your own keep your insured at all times.

* Buy floater plan to cover entire family

* Opt for a cashless plan, keep cashless mediclaim cards at hand

* Ask insurers for premium rates to find the cheapest policy

* Keep an eye on exclusions and inclusions in the policy

* Undergo medical tests, if required

* Buy health insurance even if you have one from your employer.



11.  What is the amount of the deduction?

For Individual

    · Basic deduction: Mediclaim premium paid for Self, Spouse or dependant children. Maximum deduction Rs 15,000. In case any of the persons specified above is a senior citizen (i.e. 65 years or more as of end of the year) and Mediclaim Insurance premium is paid for such senior citizen, deduction amount is enhanced to Rs. 20,000.

    · Additional deduction: Mediclaim premium paid for parents. Maximum deduction Rs 15,000. In case any of the parents covered by the Mediclaim policy is a senior citizen, deduction amount is enhanced to Rs. 20,000.

For HUF


      Mediclaim premium paid for any member of the HUF. Maximum deduction Rs 15,000. In case any member of the HUF covered by the Mediclaim policy is a senior citizen, deduction amount is enhanced to Rs. 20,000.

Senior citizen: means who is at least of 65 year of age or more at any time during the previous year.



12. Conclusion:- Medical Insurance plans serves a dual purpose. They protect you from financial crisis during a health emergency or accident and offer you tax saving benefits as well. This encourages people, especially the salaried class to invest in protecting the future of their family while being able to utilise a maximum percentage of their salaries. You are saved from the burden of paying huge medical bills and income tax, with a health insurance policy in hand.



EXAMPLE- 1

1. An individual assessee pays (through any mode other than cash) during the previous year medical insurance premia, out of his taxable income, as under:



(i) Rs 12,000/- to keep in force an insurance policy on his health and on the health of his wife and dependent children;



(ii) Rs 17,000/- to keep in force an insurance policy on the health of his parents.



He will be allowed a deduction of Rs 27,000/- (Rs. 12,000/- + Rs. 15,000/-) if neither of his parents is a senior citizen. However, if any of his parents is a senior citizen, he will be allowed a deduction of Rs 29,000/- (Rs.12,000/- + Rs.17,000/). Whether the parents are dependent or not, is not a consideration for deciding the deduction under the new provisions.

Further, in the above example, if cost of insurance on the health of the parents is Rs 30,000/-, out of which Rs 17,000/- is paid (by any non-cash mode) by the son and Rs 13,000/- by the father ( who is a senior citizen), out of their respective taxable income, the son will get a deduction of Rs 17,000/- ( in addition to the deduction of Rs 12,000/- for the medical insurance on self and family) and the father will get a deduction of Rs 13,000/-.



EXAMPLE 2

An individual assessee pays through credit card during the previous year health insurance premium as under:


   1. Rs. 12,000 to keep in force an insurance policy on his health and on the health of his wife and children

   2. Rs. 17,000 to keep in force an insurance policy on the health of his parents.

     

Under the proposed new provisions, he will be allowed a deduction of Rs. 27,000 (Rs. 12,000 + Rs. 15,000) if neither of his parents is a senior citizen. However, if any of his parents is a senior citizen, he will be allowed a deduction of Rs. 29,000 (Rs. 12,000 + Rs. 17,000). Whether the parents are dependent or not, is not a consideration for deciding the deduction under Section 80D.



EXAMPLE- 3

Question:- In the last budget, the finance minister announced exemptions for Mediclaim charges paid for senior citizens. However, I am not sure if it has yet been notified and effective. I need to take medical insurance for both my parents, who are senior citizens. I would appreciate if you can let me know.



Answer:- Earlier Sec 80D deduction in respect of medical insurance premium was Rs 15,000 for an individual and Rs 20,000 for a senior citizen. However, from this year, if someone were to buy medical insurance for his parent/s, an additional deduction of Rs 15,000 (over and above Rs 15,000) will be available. If such parent/s were senior citizen, the additional deduction would be Rs 20,000. So a person insuring himself, his spouse, children and parents could potentially get a deduction of Rs 35,000. This provision is effective from 1.4.08.

Wrong Debits through ATM's - Resolve within 7 day Says RBI

Friends,

It's a good news for the users who use their ATM's frequentally. While useing ATM there are some problems due to some technical faults and user have to suffer for this. Now RBI has directed all banks to resolve customer complaints in 7 working days from date of complaint. Earlier the period was fixed 12 days.This notification is applicable from 01.07.2011.

Most of the bank customers like us is not aware of this fact and visiting banks many times for corrective action but every time bank employees told him to visit another day .so this directive is helpful for customer and they may quote this directive in their application .

Money life has posted a case where bank has paid around six thousand for not taking corrective action for a transaction of 1000 Rs only . so note this circular and we wish you happy Banking

Reconciliation of failed transactions at ATMs 

Madam / Dear Sir

Please refer to our letter DPSS No. 711 / 02.10.02 / 2008-2009, 1424 / 02.10.02 / 2008-2009 and 101 / 02.10.02 / 2009-2010dated October 23, 2008, February 11, 2009 and July 17, 2009 respectively on the captioned subject.

2. Reserve Bank has been continuously monitoring the implementation of various directions by the banks. Based on a review of the developments and with a view to further improve the efficiency of operations, it has been decided as under :-
a. The time limit for resolution of customer complaints by the issuing banks shall stand reduced from 12 working days to 7 working days from the date of receipt of customer complaint. Accordingly, failure to recredit the customer’s account within 7 working days of receipt of the complaint shall entail payment of compensation to the customer @ Rs. 100/- per day by the issuing bank.
b. Any customer is entitled to receive such compensation for delay, only if a claim is lodged with the issuing bank within 30 days of the date of the transaction.
c. The number of free transactions permitted per month at other bank ATMs to Savings Bank account holders shall beinclusive of all types of transactions, financial or non-financial.
d. All disputes regarding ATM failed transactions shall be settled by the issuing bank and the acquiring bank through the ATM system provider only. No bilateral settlement arrangement outside the dispute resolution mechanism available with the system provider is permissible. This measure is intended to bring down the instances of disputes in payment of compensation between the issuing and acquiring banks.

3. The directive is issued under section 18 of Payment and Settlement Systems Act 2007, (Act 51 of 2007).Non-adherence to the provisions of this circular shall attract penalty as prescribed under the Payment and Settlement Systems Act 2007 (Act 51 of 2007).

4. This directive shall come into effect from July 01, 2011

5. Banks may widely publicise these changes at all ATM locations and by individual intimation to customers.

M. D. University Syllabus for Clerk-cum- Junior Data Entry Operator Test and Download Admit Cards


Syllabus and other Instructions for General Aptitude Test

A. General Instructions

i) Max. Marks : 75

ii) Time : 75 minutes

iii) Marks for questions are indicated against each. There will be ½ negative mark for each wrong answer.

iv) Maximum 75 marks will be reduced proportionately to 15.

v) Minimum Pass Marks : 7.5 out of 15 marks

vi) Medium English as well as Hindi

vii) Question paper will be of Objective Type except paragraph and Letter Writing in English & Hindi Sections.

viii) There will be five Sections of the Question Paper. Each Section will carry 15 marks.

B. Syllabus

Syllabus and other Details for Computer Typing/ Data Entry Test Test Based on Typing and Use of Other Commands in MS Word.

Max. Marks: 25 Time: 10 minutes
Each candidate will be given text of length of 350 words, and will be evaluated on the basis of typing efficiency (speed and ccuracy). Scale of evaluation shall be as under:

Marking Scale =1 mark for every 14 correct words.
Minimum Pass Marks =12.5

Test Based on Typing and Use of Other Commands in MS Power Point
Max. Marks: 13 Time: 15 minutes

Each candidate will be required to prepare 13 slides each of 26 words using various commands (open, create, format, making word bold, italics, underlining words, bullets and numbering items, making paragraph alignment, color schemes, save, applying themes, presentation styles, time rehearsal etc.)

Scale of evaluation is given hereunder:
Marking Scale =1 mark for each correct slide
Pass marks: 6.5
Test Based on typing and Use of Other commands in MS Excel
Max. Marks: 12 Time: 15 minutes

Each candidate will be required to enter data of 12 records each of 12 fields using various commands (open, create, format and save a worksheet); use of various shortcut keys; graph plotting; charting techniques; Use of various formulae (Mathematical, financial, Statistical). Scale of evaluation is given as under:

Marking scale = ½ mark for creation of each correct blank field with heading & ½ mark for each correctly filled field & no mark for partially filled field.

Minimum Pass Marks = 6

For PE : Candidates meeting the above eligibility criteria are required to appear for an online test on forenoon/afternoon on any day between 4th to 12th June, 2011 at Bangalore, Chennai, Hyderabad, Kolkata, Mohali, Mumbai, Noida, Puneand Thiruvananthapuram. The candidates can choose the date ,slot and venue. The list of candidates short-listed for interview will be published in the website of C-DAC, Noida on 13th June and the first level interview will be conducted at these locations on 14th June, 2011. Candidates short­listed based on this interview will be called for the final interview at C-DAC, Noida on 25th June, 2011.

For SPE: Candidates meeting the above eligibility criteria will be screened in based on their experience and academic performance. The final selection will be based on muIti-level interviews to be con ducted in CD AC, Noida on 23rd &24th June, 2011.

State Bank of India Clerical Results 2011

State Bank of India had advertised for recruitment to 6100 posts of clerks in 2010. The recruitment advertisement was for recruitment to clerical cadre posts in Associate Banks of State Bank of India. Written test for the clerical posts were held on 16 & 33 January 2011. SBI has declared the results and intimation regarding the written test results is being sent by SMS. Those who had appeared in the written test they should check their mobile which you had entered in application from for the results message.

e-Filing for A/Y 2011-12 Starts

Friends,

Income Tax Department has started the e-Filing facility to file your Income Tax Returns HERE for the Assesment Year 2011-12. The Return Preparation Utility (RPU) for ITR-1 (SAHAJ) and ITR-2 are now available at the Income Tax Site. What you need is first of all check which form is applicable to you. Here are the Status as defined like as  Individuals, HUF , Firms, Associations of Persons (AOP), Body of Individuals (BOI), Local Authority, Companies, Trusts, Fringe Benefit Tax (FBT) Return .


Steps to  e-File Your Income Tax Return :-

1     First of all Select appropriate type of Return Form which is applicable according to your status.
   
2     Download Return Preparation Software for selected Return Form.
   
3     Fill your return offline and generate a XML file.
   
4     Register and create a user id/password
   
5     Login and click on relevant form on left panel and select "Submit Return"
   
6     Browse to select XML file and click on "Upload" button
   
7     On successful upload acknowledgement details would be displayed. Click on "Print" to generate printout of acknowledgement/ITR-V Form.
   
8     Incase the return is digitally signed, on generation of "Acknowledgement" the Return Filing process gets completed. You may take a printout of the Acknowledgement for your record.
   
9     Incase the return is not digitally signed, on successful uploading of e-Return, the ITR-V Form would be generated which needs to be printed by the tax payers. This is an acknowledgement cum verification form. The tax payer has to fill-up the verification part and verify the same. A duly verified ITR-V form should be mailed to “Income Tax Department – CPC, Post Bag No - 1, Electronic City Post Office, Bangalore - 560100, Karnataka, ” BY ORDINARY POST OR SPEEDPOST ONLY within 120 days after the date of transmitting the data electronically.

ITR-V sent by Registered Post or Courier will not be accepted.

No Form ITR-V shall be received in any other office of the Income-tax Department or in any other manner. In case, Form ITR-V, is furnished after the above mentioned period, it will be deemed that the return in respect of which the Form ITR-V has been filed was never furnished and it shall be incumbent on the assessee to electronically re-transmit the data and follow it up by submitting the new Form ITR-V within 120 days. This completes the Return filing process for non-digitally signed Returns.
   
10     For any assistance in electronic filing please contact the Public Relations Officer of the local Income Tax Office.

Dos and Dont's for printing and submitting of ITR-Vs to ITD-CPC Bangalore

1. Please use Ink Jet /Laser printer to print the ITR-V Form. Avoid printing on Dot Matrix printer.
2. The ITR-V Form should be printed only in black ink. Do not use any other ink option to print ITR V.
3. Ensure that print out is clear and not light print/faded copy.  Please do not print any water marks on ITR-V. 
4. The only permissible watermark is that of "Income tax Department" which is printed automatically on each ITR-V.

5. The document that is mailed to CPC should be signed in original in BLUE INK. Photocopy of signatures will not be accepted. The signatures or any handwritten text should not be written on Bar code. Bar code and numbers below barcode should be clearly visible.

6. Only A4 size white paper should be used. 
7. Avoid typing anything at the back of the paper.
8. Perforated paper or any other size paper should be avoided.
9. Do not use stapler on ITR V acknowledgement.
10. In case you are submitting original and revised returns, do not print them back to back. Use two separate papers for printing ITR-Vs separately.
11. More than one ITR-V can be sent in the same envelope.
12. Please do not submit any annexures, covering letter, pre stamped envelopes etc. along with ITR-V.
13. The ITR-V form is required to be sent to Post Bag No.1, Electronic City Post Office, Bengaluru, Karnataka-560100, by ordinary post or speedpost.
14. ITR-Vs that do not conform to the above specifications may get rejected or acknowledgement of receipt may get delayed.

Amendments to Service Tax Law w.e.f. 1st May 2011

Friends,

Here are some major amendments to Service Tax Law which is effective from May 01, 2011 (AFTER ENACTMENT OF FINANCE BILL 2011). 



a) Service tax is being imposed on the following specified services:
i) Services provided by air-conditioned restaurants having a license to serve alcoholic beverages in relation to serving of food and/or beverages. Abatement of 70% is being provided.
ii) Short-term accommodation provided by a hotel, inn, guesthouse, club or campsite, or any other similar establishment for a continuous period of less than three months. Exemption is provided where the declared tariff is less than Rs.1,000/- per day. In other cases, abatement of 50% is being provided.
b) Scope of certain existing services is being expanded or altered as follows:
i) The scope of the ‘Life insurance service’ is being widened to cover all services provided to a policyholder or any person, by an insurer, including re-insurer carrying on life insurance business. It is also being provided that tax shall be charged on the portion of the premium other than what is allocated for investment, when the break-up of premium is shown separately in any document given to the policy holder. The composition rate is also being increased from 1% to 1.5%.
ii) The scope of the ‘Club or association service’ is being expanded to include service provided to non-members within its ambit.
iii) The scope of ‘Authorized service station service’ is being expanded to:
(1) include services provided by any person;
(2) cover all motor vehicles other than those meant for goods carriage and three-wheeler scooter auto-rickshaws; and
(3) Also cover the services of decoration and similar services in respect of vehicles along with the services already covered.
iv) The definition of ‘Business support services’ is being amended to include the services provided by way of operational or administrative assistance in any manner.
v) The scope of Legal consultancy services is being expanded by bringing within its ambit the:
(1) service provided by a business entity to any person in relation to advice, consultancy or assistance in any branch of law, in any manner;
(2) representational service provided by any person to any business entity (representational services, provided by an individual to individuals will continue to be exempt); and
(3) service of ‘arbitration’ provided by an arbitral tribunal to any business entity.
vi) In the Commercial Training or Coaching service, the definition of “Commercial training or coaching centre” is being amended to bring all unrecognized courses within the tax net, irrespective of the fact that such courses are conducted by an institute which also conducts courses which may lead to grant of a recognised degree or diploma. However, vide Notification w.e.f. 1-May-2011, exemption is provided to preschool coaching and training and any coaching or training leading to grant of a certificate or diploma or degree or any educational qualification which is recognised by any law for the time being in force.
vii) The scope of Health services is being expanded by including:
(1) All services, including diagnostic services, provided, by a centrally air-conditioned (wholly or partially) clinical establishment having more than 25 beds for in-patient treatment during any part of the year;
(2) Diagnostic services being provided by a clinical establishment with the aid of laboratory or other medical equipment; and
(3) Services provided by a doctor, not being an employee of a clinical establishment, from the premises of such establishment.
However, exemption is granted to the aforesaid health services w.e.f. 1-May-2011.

c) Withdrawal or amendments to existing Exemptions:
i) Exemption from service tax on the membership fees under ‘Club or association service’ is being given to the associations or chambers representing industry or commerce with retrospective effect for the period from 16.06.2005 to 31.03.2008. Tax paid on such services will be refunded and the refund application has to be made by 7-Oct-2011.
ii) Retrospective effect is being given to notification No.20/2009-ST dated 07.07.2009 exempting service tax on inter-State or intra-State transportation of passengers in a vehicle bearing Contract carriage permit or a tourist vehicle permit for the period from 01.04.2000 to 06.07.2009. Tax paid on such services will be refunded and the refund application has to be made by 7-Oct-2011.
iii) Exemption to practicing CA/CS/ICWA on representation services before statutory authority is being withdrawn.
d) CENVAT Credit Rules, 2004:
i) Rule 3 is being amended retrospectively with effect from 18.04.2006 to provide that the credit of service tax paid under section 66A i.e. service tax paid on reverse charge basis on services received from outside India, shall also be permissible.
e) Amendments in the Act: Chapter V of Finance Act, 1994 is being amended to,—
i) Omit sub-section (1A) of section 73 together with both the provisos to sub-section (2) of section. As a result, the benefit of reduction of penalty available in cases of fraud, collusion, etc. under proviso to section 73 (1A) shall not be available. Further, a new sub-section 4A is being inserted in section 73 to provide for reduced penalty in cases where during the course of audit, verification or investigation it is found that the transactions not reported to the department are available in the records or invoices. Moreover, penalty is being reduced to 1% per month of the tax amount upto a maximum of 25%.
ii) Reduce the penalty for delayed payment under section 76 from 2% to 1% per month or Rs.100 per day, whichever is higher. Maximum penalty reduced to 50% of the tax amount.
iii) Increase the maximum penalty under section 77 (for contravention of rules and provisions of Act for which no penalty is specified elsewhere) from Rs.5,000 to Rs.10,000.
iv) Amend section 78 to revise the maximum penalty. Penalty will be hereafter mandatory and equal to tax evaded. Moreover, in situations covered under section 4A, the penalty shall be 50% of the tax amount. Further, the penalty is being reduced to 25% if the tax dues are paid within one month together with interest and reduced penalty. For assessees having a turnover of upto Rs.60 lakh in any of the years covered in the show cause notice or in the preceding year, the period of one month shall be revised to 90 days.
v) Reduce interest rate on late payment / excess collection of service tax by 3% for assessees with a turnover of upto Rs.60 lakh, both under section 73B and section 75.
vi) Increase the maximum penalty for delay in filing of return under section 70 from Rs.2000 to Rs.20000. However, the existing rate of penalty for the first 15 days and for the subsequent 15 days as well as the daily penalty of Rs.100 per day thereafter under rule 7C of the Service Tax Rules, 1994 are being retained without any change.
vii) Amend the power to waive penalty under section 80. While penalties under section 76 and 77 are being retained, penalty under section 78 is being capped at 50% of tax payable in cases where the transactions are available in the specified records and at 25% in cases where tax payable & interest thereon is paid within 30 days of date of Order.
viii) Give power to issue search warrant under section 82 at the level of Joint Commissioner and the execution of such warrant at the level of Superintendent.
ix) Make section 9A, 9AA, 9B, 9E, 34A and new section 35R of the Central Excise Act, 1944 applicable to service tax under Section 83.
x) A new section 88 is being inserted so as to create first charge on the property of the defaulter for recovery of service tax dues from such defaulter subject to provisions of section 529A of the Companies Act, the Recovery of Debt due to Bank and Financial Institution Act, 1993 and Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.
xi) Reintroduce the provisions relating to prosecution under section 89 as follows:
(1) The prosecution shall apply in the following situations:
(a) Provision of service without invoice;
(b) Availment and utilization of CENVAT credit without receipt of inputs or input services;
(c) Submitting false information; and
(d) Non-payment of collected amount of service tax for a period of more than six months.
(2) The sanction for the prosecution will be granted at the level of Chief Commissioner.
